OFFICE MEMORANDUM

Subject:-    OPTION FOR RE-FIXATION OF PAY.

          The undersigned is directed to state that in terms of Finance Division’s Office Memorandum NO. F. 3(2)Gaz.Imp.I/75 dated the 14th October, 1975 such civil servants who are promoted before reaching at the maximum of their pay scales to a higher pay scale between 2nd June and 30th November of a year were allowed to opt for re-fixation of their pay in the higher scale concerned, w.e.f. first of December of the year of their promotion with reference to their presumptive pay on that date in their pre-promotion scale.

2.             While said Office Memorandum (dated 14th October, 1975) did not cover the cases of Selection Grande, (due to non existence of Selection Grade scheme at that time), the exercise of option for re-fixation of pay in cases of Selection Grade and move-over was barred vide this Division’s letter No. F.1(2)Imp/98-140/Imp/97 dated 30-04-1995, addressed to the Office of the Auditor General of Pakistan.

3.            As selection grade is treated at par with promotion for the purpose of fixation of pay, it is decided, in partial modification of this Division letter dated 30.04.1998, that the concession of option for re-fixation of pay in the higher scale as contained in this Division’s Office Memorandum dated 14-10-1975 be extend-able and applicable to the cases of Selection Grade with effect from the date it was barred by the Finance Division i.e. 30-04-1998.

Subject: -       UP-GRADATION OF THE POST OF TELEPHONE OPERATOR FROM BS-07 TO BS-09.

            The undersigned is directed to refer to subject cited above and convey the approval of Finance Division to the up-gradation of the post of Telephone Operator from BS-07 to BS-09 in all the Ministries/Division/ Departments of Federal Government as per recommendations of Establishment Division's made vide O.M. No. 8/54/2007-R-I dated 14-05-2014 subject to the following conditions:-

i)            Enhancement in the prescribed educational qualification for the post from Matric to Intermediate with two years experience in the relevant field,

ii)               Amendment in the Recruitment Rules and filling up the upgraded posts in the manner prescribed in Establishment Division's d.o. letter dated 31-12-2008.

iii)              The up-gradation of existing incumbents of the post of Telephone Operator presently working in. the Federal Ministries/ Divisions/ Departments as one time dispensation.

                        In continuation of Finance Division’s O.M. No. 13 (13)-Reg-6/2011 dated 21st January, 2013, the undersigned is directed to say that it has been decided to implement the judgment of Federal Service Tribunal, Islamabad dated 05.01.2012 upheld by Supreme Court of Pakistan vide Judgment dated 24.04.2012 in respect of all the equally placed pensioners with effect from 1st July, 2013, in view of the fact that budgetary cover is not provided in the current financial year for this unforeseen expenses. This is subject to the condition that if the constitutional petition to be filed by the Government is accepted by the Apex Court, the Government would recover the amount of increases in pension on restored portion of pension being allowed to them. The beneficiaries of this O.M. are required to furnish an undertaking on Judicial Paper for Rs.50/- as per enclosed format, to the concerned accounts Officer.

                        The undersigned is directed to say that M/s Mirza Muhammad Ishaque, Ghulam Mustafa & others filed appeals in the Federal Service Tribunal, Islamabad praying that the respondents may be directed to allow all increases sanctioned by the Government Pakistan during the period from their retirement till restoration of commuted portion of pension with all consequential benefits. The Federal Service Tribunal accepted the appeals vide its Judgment dated 05.01.2012 and  directed to determine the pension of the appellants from the date of restoration of their commuted pension at the rate at which they were drawing 50% remaining pension and that the arrears should also be paid to them. It was also clarified by the Federal Service Tribunal that the appellants shall not be entitled to claim arrears for the period prior to restoration of their commuted pension. The Supreme Court of Pakistan vide its order dated 24.04.2012 in Civil Petition No. 549 to 559 & 575 to 589 to 2012 upheld the judgment of Federal Service Tribunal dated 05.01.2012. The Review Petition filed by the Finance division in the Apex Court was dismissed on 13.09.2012 due to non-prosecution. Civil Misc. application for restoration of review petition was also dismissed by the Supreme Court of Pakistan on 16.11.2012.

2.                     Similarly, M/s Abdus Saeed Sabir and M.M. Malik field writ petitions No.4968/Writ/2011 and 3463/Writ/2011 in the Lahore High Court, Lahore on the same subject. The Lahore High Court, Lahore vide its orders dated 15.06.2011 and 20.08.2011 accepted the writ petitions.

3.                     Finance Division intends to file a Constitutional Petitions before the Honourable Supreme Court of Pakistan under Article 184(3) of Constitution of the Islamic Republic of Pakistan to revisit its Judgment dated 24.04.2012.

4.                     In the meanwhile, the Government has decided to implement the judgment passed by Federal Service Tribunal on 05.01.2012 and upheld by the Honourable Supreme Court of Pakistan vide its Judgment dated 24.04.2012 in respect of the litigants  in the above referred appeals and writ petitions  subject to the condition that if the constitutional petition field by the Government is accepted by Apex Court, the Government would recover the amount of increase in pension on restored  portion of pension being allowed to the appellants/petitioners through this O.M. The beneficiaries of this O.M. are required to furnish an undertaking on judicial Paper for Rs. 50/- as per enclosed format, to the concerned Accounts.

Subject:-    GRANT OF MEDICAL ALLOWANCE TO CIVIL EMPLOYEES/        PENSIONERS OF THE FEDERAL GOVERNMENT.

                        In partial modification of this Division’s O.Ms. No. 1(1)Imp/2010-622, and No. F.16(1)Reg-6/2010-778 both of dated 5th July, 2010 regarding the subject mentioned above, the undersigned is directed to state that it has been decided in consultation with Ministry of Health that serving/retired civil employees of the Federal Government or member of his/her family, suffering from the following chronic diseases, will be entitled for reimbursement of amount spent on account of purchase of medicines for the medical treatment at OPD:-

1)     
Chronic pulmonary-cardiovascular and circulatory disorders.
2)     
Tumours, maliganancies, cancer and chronic blood disorders (Thallassaemias etc.)
3)     
Chronic hepato-renal disorders, organ failure, dialysis and transplants.
4)     
Chronic neuro-psychiatric diseases,   neuropathies, epilepsy, paralysis.
5)     
Chronic inflammatory-infectious diseases (rhematoid arthritis, hepatitis, TB, tetanus etc.)
6)     
Chronic endocrine disorder (diabetes/goiter pancreatitis etc).
7)     
Chronic degenerative disorders.
8)     
Poisoning, dog and snake bite.
9)     
Drug Abuse, STD, HIV/AIDS, VHF.
10)  
Chronic skin diseases, allergies – chronic connective tissue and immune disorders.
11)  
Injuries including orthopedics, burns, gunshot, blast and head  injuries.
12)  
Day surgery (obstetric-gynae disorders, deliveries, cataract and eye/ ENT day procedures).
13)  
Shock, cardiogenic shock, stroke and electrolyte disorders.
14)  
Treatment for eye, ENT and disabilities/handicapps.

Dental treatment.

2.                     The financial impact arises-out from reimbursement of medical charges in the matter will be met out of the allocated budget for the year 2010-2011 by the respective Ministries/Divisions and no supplementary grant would be given on this account.

3.                     Ministry of Health will issue necessary instructions for constitution of a Medical Board at each Government Hospital, which will examine the serving/retired Government servant or a member of his/her family and decide suffering from chronic disease, not covered under the above stated list, for reimbursement of medical expenses incurred for the treatment in OPD and their decision shall be final.
