Departmental representation for upgradation of post of Superintendent from BPS-16 to BPS-17

Subject:          REQUEST FOR UPGRADATION OF THE POST OF SUPERINTENDENT FROM BPS-16 TO BPS-17 ALONGWITH INCUMBENTS IN THE GEOLOGICAL SURVEY OF PAKISTAN.

Dear Sir,
                        I have the honor to state that Finance Division (Regulation Wing) vide its Office Memorandum No. F. 6(4)R.I/2006 dated 29.06.2007 has conveyed the approval of President of Pakistan regarding upgradation of following Clerical/ Auditors posts along with incumbents as detailed below w.e.f. 01.07.2007.

The Cabinet Secretariat, Establishment Division vide its notification No. S.R.O. 823(I)/2007 dated 08.08.2007 has amended recruitment rules of Ministerial staff as a result of upgradation of the posts of Assistant from BPS-11 to BPS-14, U.D.C. BPS-07 to BPS-09 and L.D.C. BPS-5 to BPS-07 and to this effect was issued.

2.                     Later on Controller General of Accounts, Islamabad vide its Notification No. 455/Estt-III/150-C/Court/Creation of Posts/2008 dated 20.04.2010 in continuation of its notification of even number dated 03.04.2010 and in pursuance of Finance Division O.M. No. F. 9(9)-R/2008-335 dated has upgraded the following posts along with incumbents in the departmentalized accounts offices under the Controller General of Account Organization,

The Geological Survey of Pakistan has departmentalized Accounts under the administrative control of Controller General of Accounts; therefore, the posts of Accounts Officer, Assistant Accounts Officer were upgraded along with incumbents working against these posts.

3.                     Soon after Controller General of Accounts, Islamabad vide its Notification No. 54/Estt-II/AO/238-C/2008 dated 14.01.2011 in pursuance of Establishment Division letter NO. 8/57/2009-R-1 dated 10.06.2010 read with Finance Division O.M. No. F. 1(6)-R-I/2009-1069 dated 20.12.2010 has approved the upgradation/ re-designation of the posts of Accounts Superintendent, BPS-11 as Senior Auditor, BPS-16 and Accounts Assistant, BPS-9 as Junior Auditor, BPS-11 in the office of Chief Accounts Officer, Geological Survey of Pakistan. Now it has come to the knowledge that the posts of Stenographer, BPS-15 and Stenotypist, BPS-12 are also being upgraded to BPS-16 and BPS-14 respectively.

4                      Keeping in view the above it is submitted that all the Ministerial and Auditors posts have been upgraded but the post of Superintendent (BPS-16) being part of Ministerial cadre as notified vide Cabinet Secretariat, Establishment Division Notification No. S.R.O. 1077(I)/2005 dated 15.10.2005 was neglected and not upgraded which is injustice with the incumbents is working against the posts of Superintendent (BPS-16) because in the same department Auditors/Accounts posts along with incumbents upgraded twice but the post of Superintendent (BPS-16) was not placed under consideration for upgradation, even for a single time.

5                      It is therefore, requested that the Establishment Division and Finance Division may be approached for upgradation of the post of Superintendent from BPS-16 to BPS-17 along with incumbents similar to upgradation of Ministerial and Auditors/Accounts posts in the past to fulfill the modes of justice.

Upgradation of Posts and Procedure for Filling-up of Upgraded Posts

Upgradation of a post does not mean automatic upgradation of its incumbent. Appointment to the upgraded post will have to be made in the manner prescribed for that post. If a post is upgraded with immediate effect, the incumbent would be left without any post (in his grade*) until he is approved for appointment to higher grade.
Establishment Division has been receiving proposals for upgradation of posts with immediate effect and also for upgradation of their incumbents. It is clarified that upgradation of a post implies the abolition of the existing post and creation of a new post in the higher grade.

2. In view of the position explained above, all Ministries/Divisions are requested that while sanctioning upgradation of the existing posts, it should be clearly provided in the sanction letter that upgradation of the post would take effect from the date the post is filled by a person in the higher grade. This would ensure that until the existing incumbent is formally appointed to higher grade, the post and the incumbent would continue in lower grade

Upgradation of Posts

In continuation of Establishment Division’s O.M. No. 8/130/91-R.I, dated 3rd December, 1991, it is stated that the President under sub-para ‘F’ of para 3 of the Presidential directive No. 57/1/CMLA, dated 2nd August 1979 had, inter-alia, frozen upgradation of posts till further orders. Prior to this, the upgradation of posts used to be made with the approval of the Finance Division and Establishment Division. However, after the directive, all the cases of upgradation of posts are submitted to the Prime Minister for approval, in relaxation of the above Presidential directive with the concurrence of Finance Division and Establishment Division.

2. It has come to the notice of the government that Ministries/ Divisions/Departments etc. are upgrading the posts without the approval of the competent authority i.e. the Prime Minister and concurrence of the Finance Division (Regulations Wing) and Establishment Division. Similarly, the appointments against the upgraded posts are being made by the Ministries/Divisions/Departments etc. without going through the prescribed selection process or approval of the competent authority. It may be pointed out that the upgradation of posts does not mean automatic upgradation of the incumbents. The appointment against the upgraded post will have to be made in the manner prescribed in the recruitment rules for that post and with the approval of the competent authority. Therefore, upgradations of posts made by the Ministries/Divisions/Departments etc. and appointment of their incumbents against such posts without going through the prescribed selection process or approval of the competent authority are irregular.

3. In view of the above, Ministries/Divisions are requested not to make any upgradation without the concurrence of Finance Division (Regulations Wing) and Establishment Division and the approval of the Prime Minister. The upgradation of posts, made by the Ministries/ Divisions without this process, may be submitted for regularization etc. in the prescribed procedure and for approval of the competent authority. The above position may also be brought to the notice of all Departments/Autonomous/Semi-Autonomous Bodies/Corporations etc. under the administrative control of the Ministries/Divisions.
