Subject: COUNTING
OF SERVICE RENDERED AGAINST HIGHER POST UNDER SECTION 10 OF THE
CIVIL SERVANTS ACT, 1973
The
undersigned is directed to state that Section 10 of the Civil Servants
Act, 1973 reads as under:-
“10.
Posting and transfer.- Every civil servant shall be liable to serve
anywhere within or outside Pakistan, in any equivalent or higher post under
the Federal Government, or any Provincial Government, or local authority, or
a corporation or body set up or established by any such Government;
Provided that nothing contained in this section shall apply to a
civil servant recruited
specifically to serve in a particular area or region:
Provided further that, where a civil servant is required to serve in
a post outside his service
or cadre, his terms and conditions of service as to his pay shall not be less favourable than
those to which he would have been entitled if
he had not been so required to serve.”

A point was raised how the service rendered by a civil servant
posted against a higher post under Section 10 of the Civil Servants Act, 1973
would be counted for the purpose of promotion to higher post of the said
civil servant.

The matter has been given careful consideration in the Establishment
Division. It has been observed that according to Section 5 of the Civil Servants
Act, 1973 all appointments are required to be made in the prescribed
manner i.e. on the recommendations of appropriate
Departmental Promotion / Selection Committee(s) or Board(s), as the case may
be and with the approval of the designated appointing authorities followed by
a notification promoting such civil servant to higher grade.

Section 10 of the Civil Servants Act, 1973 is a liability provision
i.e. a civil servant is liable to serve in an equivalent or
higher post. Promotion to a higher post and holding temporary charge of
a post are two different aspects. Legally, a person is not in a higher
grade until his promotion to the higher post is duly notified and charge of
the higher post is formally assumed by him.

It has therefore been decided that the service rendered by a civil servant
against higher post under Section 10 of the Civil Servants Act, 1973 cannot
be treated at par with the service rendered by regularly promoted
officers in the higher scale for the purpose of promotion to the
next higher grade.

The decision may be brought to the notice of all concerned.

Subject: Appeal Under
Section-4 Of The Service Tribunal Act, 1973.
The undersigned is
directed to refer t-II/2012-144-R.I/2013, dated 29th March, 2013
on the above subject and to say that at present employees working in
Ministries/ Divisions/Departments are of the view that up-gradation of posts means
automatic up-gradation of its incumbents. This concept is incorrect,
Establishment Division’s O.M. No. 5(1)/67-DV, dated 16.10.1967, read with
O.M. No. 8/130/91-R-I, dated 12th May, 1992 (copies enclosed)
provides that up-gradation of posts means abolition of previous post and
creation of new post in higher scale. Appointment to up-graded posts will
have to be made in the manner prescribed in the Recruitment Rules approved by
Establishment Division/FPSC.
2. In the instant appeal &
in many other appeals / writ petitions received in Establishment Division, it
is observed that employees who are not promoted since long are inspired from
up-gradation of other posts and hence, they aspire for up-gradation of their
posts several employees, whose cases were not covered under up-gradation
policy and hence rejected by this Division or by their parent Ministry/Division
file writ petitions in courts praying for up-gradation of their posts. Due to
above referred court cases the work load of Establishment Division/ Finance
Division has considerably been increased.
3. Establishment Division is
of the view that in order to decrease the number of court cases and bring
uniformity, Finance Division may constitute a committee comprising expert
members to formulate a uniform time scale promotion policy applicable on
civil servants working under the Federal Government.

letter No. 6/3//92-OMG-II, dated 6th December, 1993 (copies
enclosed) and to state that instances have come to the notice of the
Government where officer(s) on promotion or transfer to other Ministry(s) /
Division(s) are not relieving promptly by the offices where they were serving
to enable them to take up their new assignments. Similarly, in certain cases,
the transferred officers are not taken on charge / accepted in their new
assignments on one pretext or the other. This tendency of not honoring the
Notifications issued by this Division, in public interest, creates
administrative difficulties / problems for the Ministries / Divisions where
such officers are being posted.
2. In view of above it is
once again reiterated that whenever orders of transfer / posting of an
officer are received these should be implemented in letter and spirit. In
case of noncompliance this Division will be constrained to take action
against the officers under transfer.

The undersigned is
directed to refer this Division’s O.M. No. 30/2/90-CP-3 dated 18.02.1997 (printed
overleaf) which inter alia provided for regularizing the promotion of
officers who were earlier promoted against deputation, leave etc. vacancies
on the ground that regular vacancy has occurred subject to satisfaction of
the conditions prescribed under the above referred O.M. A number of
references are received in the Establishment Division regarding clarification
for extending the applicability of this O.M. to the cases of initial
appointments made against temporary vacancies.
2. The matter was considered
in the Establishment Division and it has been decided to extend the
applicability of instructions contained in the above referred O.M. dated
18.02.1997 to cases of initial appointment as well subject to the following
conditions:-
(i)
The initial appointment against
the temporary vacancy is made in the manner prescribed for appointment
against regular vacancy duly observing regional/ provincial quota and
qualification & experience prescribed in the Recruitment Rules of the
post concerned.
(ii)
The incumbent has continuously
worked on the temporary vacancy during the period from appointment to the
occurrence of the regular vacancy.
(iii)
No disciplinary/ criminal
proceedings have been initiated against him/ her during the said period.
(iv)
His/ her upto-date service record
would form the basis for assessing fitness for the continuation of subject
appointment.

Competent Authority has been pleased to approve the insertion of Para 8-A in
the Revised Promotion Policy, 2007 circulated, vide Establishment Division’s
O.M. No. 13/2007-CP-II, dated 24-10-2007 as under:-
“8-A DECLINING
FROM PROCEEDING TO MANDATORY TRAINING.
The nominations for mandatory
training having been made in order of seniority, if the officer so nominated
for training declines to proceed on training for two consecutive training
courses, then he/she would forfeit the right to consideration for promotion.
Provided
that the Prime Minister may dispense with this provision in any case in the
public interest.”
